Veja decis\u00e3o recente do STJ"},"content":{"rendered":"\n<p>O Superior Tribunal de Justi\u00e7a (STJ)<strong> <\/strong>tomou uma decis\u00e3o que impacta diretamente compradores, vendedores e condom\u00ednios.\u00a0 Em <a href=\"https:\/\/www.stj.jus.br\/sites\/portalp\/Paginas\/Comunicacao\/Noticias\/2025\/14102025-Comprador-registrado-na-matricula-do-imovel-responde-por-condominio--mesmo-sem-receber-as-chaves-.aspx\">julgamento recente<\/a>, a\u00a0 4\u00aa Turma do STJ estabeleceu que a responsabilidade pelo pagamento das taxas de condom\u00ednio recai sobre o comprador <strong>a partir do momento em que seu nome consta como propriet\u00e1rio na matr\u00edcula do im\u00f3vel<\/strong>, no cart\u00f3rio de Registro de Im\u00f3veis competente.<\/p>\n\n\n\n<p>Isso significa que o comprador \u00e9 respons\u00e1vel pela <a href=\"https:\/\/pactonet.com.br\/?p=4960\">taxa condominial<\/a> mesmo que ainda n\u00e3o tenha<em> <\/em>recebido as chaves e ocupado o apartamento.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Natureza <\/strong><strong><em>Propter Rem<\/em><\/strong><\/h3>\n\n\n\n<p>Os ministros fundamentaram esse entendimento na natureza<strong> <\/strong><em>propter rem<\/em> da obriga\u00e7\u00e3o condominial.<strong> <\/strong>&nbsp;<\/p>\n\n\n\n<p>Em termos simples, uma obriga\u00e7\u00e3o <em>propter rem<\/em> significa que<strong> a d\u00edvida est\u00e1 ligada \u00e0 pr\u00f3pria coisa (o im\u00f3vel), e n\u00e3o \u00e0 pessoa que est\u00e1 usufruindo dela no momento<\/strong>. Uma vez que o comprador registra a propriedade em seu nome, ele adquire a condi\u00e7\u00e3o de cond\u00f4mino e se torna obrigado a contribuir com as cotas.<\/p>\n\n\n\n<p>O Ministro Relator, Jo\u00e3o Ot\u00e1vio de Noronha, destacou que o registro p\u00fablico transfere a propriedade e, consequentemente, atribui a condi\u00e7\u00e3o de cond\u00f4mino, obrigado a contribuir com a <a href=\"https:\/\/pactonet.com.br\/?p=7875\">fra\u00e7\u00e3o ideal<\/a> do bem.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>A aus\u00eancia das chaves n\u00e3o isenta o propriet\u00e1rio das despesas<\/strong><\/h3>\n\n\n\n<p>Na a\u00e7\u00e3o que levou a essa decis\u00e3o, os compradores alegaram que, embora constem como propriet\u00e1rios na matr\u00edcula,&nbsp; a aus\u00eancia da imiss\u00e3o na posse deveria isent\u00e1-los das despesas de condom\u00ednio.<\/p>\n\n\n\n<p>O STJ enfatizou que falta de entrega das chaves, por si s\u00f3, <strong>n\u00e3o isenta o comprador da responsabilidade perante o condom\u00ednio<\/strong>. Desta forma, o condom\u00ednio, assim, est\u00e1 legalmente autorizado a buscar a quita\u00e7\u00e3o das cotas por meio de execu\u00e7\u00e3o de t\u00edtulo extrajudicial.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>E o direito de regresso do comprador?<\/strong><\/h3>\n\n\n\n<p>Embora o comprador seja o respons\u00e1vel legal pelo pagamento das despesas a partir do registro, Noronha ressaltou que <strong>a falta de entrega das chaves, <\/strong>por culpa da construtora ou do vendedor<strong>, pode fundamentar um direito de regresso.<\/strong><\/p>\n\n\n\n<p>Isso significa que o comprador deve pagar ao condom\u00ednio para cumprir a lei e evitar a execu\u00e7\u00e3o, mas pode buscar ser ressarcido judicialmente pela construtora ou vendedora pelos valores pagos durante o per\u00edodo de atraso na entrega.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>A responsabilidade come\u00e7a no registro, n\u00e3o na posse<\/strong><\/h3>\n\n\n\n<p>Para o Superior Tribunal de Justi\u00e7a, o que define a obriga\u00e7\u00e3o de pagar o condom\u00ednio \u00e9 a <strong>propriedade registrada<\/strong>.<\/p>\n\n\n\n<p>Se voc\u00ea est\u00e1 comprando um im\u00f3vel, monitore o registro da matr\u00edcula e prepare-se para arcar com as despesas a partir desse momento, mesmo que ainda n\u00e3o tenha as chaves.
